Terms of Service

fxVPS.io (the "Company") provides VPS hosting services designed for forex trading and financial applications. By using the service, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these terms. The Company reserves the right to refuse service to anyone at its sole discretion.

All fees are denominated in USD. Services are billed on a prepaid monthly basis and auto-renew at the end of each billing period unless cancelled. Non-payment will result in suspension within 48 hours and permanent termination with data deletion after 7 days. Payment is via Stripe (Visa, Mastercard). All services must be paid in advance. The Company reserves the right to change pricing with 30 days' notice.

Renewal Reminders: fxVPS.io will make reasonable efforts to send renewal reminders before billing dates. However, failure to receive a reminder does not constitute grounds for refusing payment or requesting a refund. Customers are responsible for keeping track of their billing dates and managing their subscriptions accordingly.

All payments are non-refundable. By completing a payment, you explicitly acknowledge and agree to this policy. The Company does not offer refunds of any kind, including but not limited to pro-rated refunds, partial refunds, or exception-based refunds.

If you have concerns about a charge, contact support@fxvps.io within 7 days of payment. The Company may, at its sole discretion, issue service credits for verified technical failures or billing errors — not cash refunds.

Strictly no chargebacks or dispute refunds across all payment gateways. For any refund request, contact support@fxvps.io directly.

Any chargeback or payment dispute initiated without first contacting support will result in:

• Immediate account suspension
• A $25 USD investigation/chargeback fee charged to the account
• Potential permanent account termination

The Company reserves the right to reject future payments from accounts with prior chargebacks.

You may cancel at any time without penalty. "Cancel anytime" means the cancellation stops the subscription from auto-renewing at the next billing date; your service remains active until the end of the current paid period, with no further charges. Fees already paid for the current billing period are non-refundable. To avoid being charged for the next billing period, cancellation requests must be submitted at least 24 hours before your next billing date via the client portal.

After the service period ends, all hosted data and services will be automatically terminated. The Company will cease to provide service or support. The Company has no obligation to retain any client data after termination.

Cancellation Confirmation: Upon submitting a cancellation request, the customer will receive a confirmation email. The customer is responsible for ensuring they have received the cancellation confirmation. If no confirmation email is received, please contact support@fxvps.io to verify. Absence of a confirmation email does not constitute proof of successful cancellation.

99.9% uptime guarantee per month.

The SLA excludes:

• Any period prior to the problem being reported to support
• Scheduled maintenance windows
• Emergency maintenance
• Planned migrations
• Server shutdown due to account suspension
• Force majeure events
• Failure of upstream providers or your ISP
• Software running within your VPS
• Actions of third parties including DDoS attacks and viruses
• User activity errors

SLA credits are proportional to actual downtime, capped at 100% of the monthly fee. Credits are service credits only, not cash refunds.

To claim SLA compensation, customers must submit a written request to support@fxvps.io within 7 days of the incident, providing the affected dates, times, and service details. Late claims will not be accepted. fxVPS.io reserves the right to make the final determination.

Latency values displayed on the website are estimates based on internal testing and may vary depending on broker server configuration, network conditions, time of day, and other factors beyond our control. fxVPS.io does not guarantee any specific latency values. The "2ms" figure is a measured value under optimal conditions and is not a guaranteed service level.

The VPS is intended for trading applications and financial software. You may run any legally obtained software. Hosting websites and media applications is discouraged. The Company may contact you if abnormal network traffic is detected. The Company may immediately suspend any VPS that abuses host system or network resources, negatively impacting other clients.

Strictly prohibited:

• Pornography
• Spam / unsolicited commercial email (UCE)
• DDoS attacks or any malicious network activity
• Pirated/cracked software, "warez", "nulled scripts"
• Cryptocurrency mining
• Services intended to scam, steal, or deceive
• Probing, scanning, or testing network vulnerabilities
• Forging TCP/IP packet headers
• Any activity violating Hong Kong or international law

Violations will result in immediate suspension without prior notice and no refund.

Sending unsolicited commercial email (UCE) or spam via our network is strictly prohibited. Upon notification of an alleged violation, the Company will initiate an immediate investigation and may restrict access during the investigation. Violations may result in unilateral account termination. The Company reserves the right to pursue civil remedies for investigation costs and will notify law enforcement if criminal activity is suspected.

The Company reserves the right to block connections to or from any service involved in DDoS attacks, packet flooding, or malicious network activity without prior notice. Services will be suspended for the time necessary to mitigate attacks. The Company may permanently terminate any service deemed to be producing malicious activity or posing a risk to network stability.

You acknowledge that forex trading and other financial instrument trading are recognised as high-risk activities. Use of VPS hosting does not reduce trading risk in any way. You acknowledge that you have obtained adequate training and education to conduct trading responsibly.

fxVPS.io provides hosting infrastructure only — not investment advice, brokerage services, or trading recommendations. The Company shall not be held responsible for any trading-related losses resulting from trades executed on systems hosted by fxVPS.io, including but not limited to losses caused by: service interruptions, latency fluctuations, software errors, EA malfunctions, broker-side issues, or any other cause.

Customer acknowledges that hosting services may be interrupted for reasons including but not limited to:

• Scheduled maintenance and system updates
• Hardware failure or replacement
• Network outages or routing issues
• Datacenter power failure or cooling system failure
• Third-party provider issues (including upstream network providers and datacenter operators)
• Operating system or virtualization platform security updates
• DDoS attacks or other malicious network activity
• Force majeure events (including but not limited to natural disasters, government actions, war, terrorism, epidemics, strikes, etc.)

fxVPS.io will make reasonable efforts to provide advance notice of scheduled maintenance but cannot guarantee advance notice in all circumstances. Emergency maintenance and security updates may be performed without prior notice.

Customer agrees that fxVPS.io shall not be liable for any losses arising from service interruptions caused by any of the above reasons.

Customer acknowledges that Expert Advisors (EAs), trading bots, and other automated trading systems may require manual restart after a VPS reboot. fxVPS.io is not responsible for restarting, configuring, or monitoring customer trading systems following service interruptions or restarts.

Customer is responsible for:

• Ensuring their trading software is configured to auto-start on boot
• Configuring MetaTrader's "AutoTrading" feature to enable automatically on startup
• Regularly monitoring the operational status of their EAs and trading systems
• Maintaining backups of all configurations and settings for their trading systems
• Verifying their trading systems are functioning correctly after VPS restarts or service interruptions

fxVPS.io shall not be liable for any trading losses, missed trading opportunities, or other financial losses resulting from automated trading systems failing to resume operation after a VPS restart.

You acknowledge that hosting services may be interrupted for many reasons other than the Company's negligence, and that damages resulting from interruption are impossible to objectively quantify. The Company shall not be liable for damages arising from causes beyond its direct and exclusive control.

The Company's total liability for any losses shall not exceed the fees paid by you during the period in which damages occurred. In no event shall the Company be liable for any special, indirect, incidental, or consequential damages, loss, or injury, including but not limited to: lost profits, lost trading opportunities, data loss, business interruption, or any other pecuniary loss.

This limitation of liability explicitly includes but is not limited to losses arising from:

• Trading losses during VPS restarts or service interruptions
• Slippage or execution issues caused by latency fluctuations
• EAs or automated trading systems failing to resume after restarts
• Trading platform connection interruptions
• Data loss or corruption
• Profits the customer expected to earn but could not realise due to service interruptions

Customer acknowledges that the nature of VPS hosting services is such that service may be interrupted for many reasons other than the negligence of fxVPS.io, and that damages resulting from any interruption of service are impossible to objectively quantify.

You are responsible for maintaining complete and current backups of your VPS and all files/software. fxVPS.io is not responsible for any files, software, or other data lost by you, regardless of cause. The Company may make internal backups for disaster recovery purposes, but these are not intended as client data backups and cannot be relied upon. The Company does not guarantee that any backup can be provided to a client.

Each VPS comes with 1 dedicated IP address. IP ownership and broadcast rights belong solely to fxVPS.io. You have usage rights only as permitted during active service. The Company reserves the right to change or remove IP addresses at its sole discretion at any time.

The Company reserves the right to suspend or terminate service without prior notice for: ToS violation, non-payment, fraud, abuse, illegal activity, or any reason deemed necessary to guarantee network/service stability. Multiple violations may result in permanent suspension with no refund. A single complaint of infringing or illegal content may be sufficient for permanent suspension. The Company reserves the right to terminate any account at any time without reason at its sole discretion. Terminated users are prohibited from creating new accounts.

You agree that the Company may disclose any and all subscriber information — including IP addresses, account history, billing records, and usage data — to any court or law enforcement agency upon receipt of a subpoena, warrant, or court order, without your consent or notification.

You agree to defend, indemnify, and hold harmless fxVPS.io, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:

• Your use of the service
• Any content hosted on your VPS
• Any products or services sold by you via our servers
• Any violation of these Terms
• Any third-party claims related to your trading activities

You are prohibited from storing or posting content that infringes the intellectual property rights of third parties, including trademark, patent, and copyright infringements. All content on the fxVPS.io website is protected by copyright and intellectual property laws. No content may be copied, published, reverse engineered, or redistributed without written permission.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue to be valid and enforceable. If a court limits a provision to make it enforceable, such provision shall be enforced as so limited.

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

The Company reserves the right to update or modify these terms at any time. Continued use of services after changes constitutes acceptance of the revised terms. The Company will make reasonable efforts to notify clients of material changes.
